Regulations

Short-term rentals are allowed within the City of Santa Fe. You will be required to have a permit for any short-term rental within a residentially zoned area or registration for Non-Residentially zoned areas.

Licenses

What you will need when applying for a short-term rental license.

Accessory dwelling units:

  • Proof of Ownership of unit
  • A floor plan that is to scale
  • A floor plan to scale of all of the bedrooms
  • Proof of compliance
  • Proof of property insurance

For Residential units:

  • Proof of Ownership of unit
  • A floor plan that is to scale
  • A floor plan to scale of all of the bedrooms
  • Proof of property ownership
  • Proof of property insurance

For Resort units:

  • Proof of exception approval
  • Proof of Ownership of unit
  • A floor plan that is to scale
  • A floor plan to scale of all of the bedrooms
  • Proof of property insurance

For Non-Residentially Zoned:

  • Proof of Ownership of unit
  • A floor plan that is to scale
  • A floor plan to scale of all of the bedrooms
  • Proof of property insurance

Once you have the correct information ready, submit the application. Then, once the application is approved, start by getting the zoning, water conservation, and Fire Inspections done. You will then be asked to pay the registration fees.

After receiving the permit, you are required to have it on the property at all times. In the first ten days, you are required to formally give your neighbors that are within 200 feet from the property, a notice informing them of the new permit.

Fines and Fees

For the Registration fees, it depends on which type of application you are applying for.

The different prices are:

Accessory Dwelling Unit = $325 per year

Residential Unit = $325 per year

Resort Unit = $100 per year, Non-Residentially

Commercially zoned Units = $100 per year
